Footprints: Herd of Hope Tour Terms and Conditions
These Terms and Conditions ("Terms") govern your participation in our free, charity-organised walking tour, known as Footprints: The Herd of Hope ("Tour") taking place on various dates in Spitalfields Market in London, United Kingdom. We reserve the right to end an attendee’s participation in the tour if this agreement is not followed.
1. About the Organiser
The Tour is organised and operated by Sheldrick Wildlife Trust UK, a registered charity in England and Wales (Charity Number: 1103836), whose registered address is 1 Oak Place, Rosier Business Park, Coneyhurst Road, Billingshurst, RH14 9DE, United Kingdom ("we", "us", "our"). The Tour is provided free of charge as part of our charitable activities.
2. Nature of the Tours
2.1 The Tour is a guided, on-foot experience conducted among pedestrian walkways, covered market arcades, and public open spaces within the Spitalfields Market Estate.
2.3 Any funds raised in connection with the Tour (e.g. voluntary donations) go directly to support our charitable purposes.
3. Your Place on the Tour
3.1 The Tour is open to persons aged 14 and over. Participants aged 14 or 15 must be accompanied by a parent or legal guardian at all times.
3.2 Your place on a Tour was confirmed when you received registration confirmation from us. Please ensure the details you provided at registration are accurate. If any details have changed (for example, the number of people in your group), please contact us as soon as possible.
3.3 If you can no longer attend, please email or telephone us in advance using the contact details at the end of this notice, so we can offer your place to others.
3.4 We reserve the right to refuse or terminate participation for any individual whose behaviour poses a risk to themselves, other participants, or the public, or who fails to comply with these Terms.
4. Health, Fitness, and Accessibility
4.1 The Tour may involve walking on uneven surfaces typical of a built, city environment. Participants should ensure they are physically capable of completing the Tour route and are wearing appropriate footwear.
4.2 If you have a health condition, mobility impairment, or disability that may affect your participation, please contact us in advance so we can advise on suitability and make reasonable adjustments where possible.
4.3 By attending the Tour, you confirm that you are in a suitable state of health to participate and that you are not aware of any medical condition that would make participation inadvisable without prior medical advice. If your health circumstances have changed since registration and you are unsure whether you should attend, please contact us or seek medical advice before the confirmed Tour date.
4.4 We do not provide medical assistance. In the event of a medical emergency, our guides will call 999 and assist until emergency services arrive.
5. Conduct and Safety
5.1 Participants must follow all instructions given by the Tour guide(s) at all times. The guide's decisions regarding safety and route matters are final.
5.2 You must not engage in any behaviour that is disruptive, offensive, dangerous, or unlawful during the Tour.
5.3 If you wish to leave the Tour early, please notify the guide before doing so.
5.4 The Tour takes place in a busy public market environment. You are responsible for your own personal safety and belongings throughout the Tour. Please be aware of your surroundings, and keep your personal property secure.
5.5 Participants must not obstruct market traders, other members of the public, or emergency access routes at any time.
5.6 The Tour takes place outside, in all weather conditions, including rain and high temperatures. Please wear suitable clothing and footwear for the weather and time of year and ensure adequate protection against the sun. Please bring enough water to drink to ensure you are adequately hydrated during outdoor activities.
6. Young Persons and Vulnerable Persons
6.1 The Tour is open to persons aged 14 and over, as set out in clause 3.1. Children under the age of 14 are not permitted to participate in the Tour.
6.2 Where a participant arrives with a child under the age of 14, we reserve the right to refuse participation to the entire group. We accept no responsibility for any inconvenience or costs arising from such refusal.
6.3 Parents and guardians are solely responsible for the supervision and wellbeing of any persons in their care during the Tour, including any child who is permitted to attend at our discretion in exceptional circumstances.
6.4 We are not responsible for any child or vulnerable person who becomes separated from their accompanying adult. If a child becomes separated from their group, our guides will contact emergency services and remain with the child until appropriate assistance arrives.
7. Liability
7.1 We take reasonable steps to ensure the Tour is conducted safely. However, to the fullest extent permitted by law:
We are not responsible for loss or theft of personal belongings;
We are not responsible for the actions of third parties, including market traders or other members of the public;
We are not responsible for conditions beyond our reasonable control, including weather, market closures, or public order incidents.
7.2 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where limitation or exclusion is not permitted by law.
7.3 You participate in the Tour at your own risk, subject to clause 7.2 above.
8. Donations
8.1 Any donation made at the point of booking or during the Tour is entirely voluntary. Making a donation is not a condition of securing or retaining your place on the Tour.
8.2 Donations are made directly to Sheldrick Wildlife Trust UK in support of our charitable purposes and are non-refundable, including in the event of Tour cancellation or postponement, except where required by law.
9. Cancellation and Changes
9.1 We reserve the right to cancel, postpone, or modify the Tour at any time due to circumstances beyond our reasonable control (including but not limited to adverse weather, market closures, public safety incidents, or direction from authorities).
We will not be liable to pay any compensation or incidental costs for expenses that you may incur because of such cancellation or for any loss or damage caused as a result of such cancellation.
9.2 Where possible, we will provide advance notice of any cancellation or significant change via the contact details you have provided.
9.3 As the Tour is free of charge, no refund of a place fee applies in the event of cancellation. Donations already made remain non-refundable as set out in clause 8.2.
9.4 If you wish to cancel your place for any reason, including if you do not accept these Terms, please notify us as early as possible so your place can be offered to others.
10. Photography and Media
10.1 We or our authorised volunteers may take photographs or video footage during the Tour for use in our charitable communications, social media, reports, or promotional materials.
10.2 If you do not wish to be photographed or filmed, please inform the Tour guide or a member of our team at the start of the Tour.
10.3 By participating without raising an objection, you consent to the use of any photographs or footage in which you may appear, in connection with our charitable activities, in accordance with our Privacy Policy.
10.4 Participants may take personal photographs and videos for non-commercial use. Please be respectful of market traders and other members of the public when doing so, and comply with any requests not to photograph from traders or market management.
11. Data Protection and Privacy
11.1 Any personal data collected in connection with the Tour (such as your name and contact details at registration) will be processed in accordance with the UK General Data Protection Regulation (UK GDPR) and our Privacy Policy, available at https://www.sheldrickwildlifetrust.org.
11.2 We will use your data to administer your participation in the Tour.
11.3 We will not sell or share your personal data with third parties for marketing purposes.
12. Intellectual Property
12.1 All content produced by us in connection with the Tour, including commentary, materials, and branding, remains the intellectual property of Sheldrick Wildlife Trust UK.
12.2 You may not record or reproduce our Tour guides' commentary for commercial purposes without our prior written consent.
13. Complaints
13.1 If you have a complaint or concern about the Tour, please speak to the Tour guide in the first instance. For unresolved complaints, please contact us in writing, using the contact details at the end of this notice, within 28 days of the Tour date.
13.2 We will acknowledge your complaint within 5 working days and aim to provide a full response within 28 days.
14. Governing Law
14.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
14.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. General
15.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.2 Our failure to enforce any provision of these Terms shall not constitute a waiver of that right.
15.3 These Terms constitute the entire agreement between you and us in relation to your participation in the Tour.
15.4 We may update these Terms from time to time. The version in force at the time of your participation shall apply.
